TERMS AND CONDITIONS

  1. LEGAL
    • It is against the law to sell or supply alcohol to or obtain alcohol on behalf of a person under the age of 18 years.
    • By completing the order and offer to purchase the liquor, all the details you have provided are vouched true and correct. It is a condition of purchase that you verify that you are 18 years of age or over.
    • If you do not verify that you are 18 years or older your order will not be processed.
    • Delivery via Australia Post cannot be left at the door and must be signed for by a person able to verify that they are over 18 years of age.
    • Your contract of sale is with Australian Food and Beverage Pty Limited, trading as Château Tanunda, ABN 64 003 376 985 under its Liquor Licence No. 51203627.
    • The sale of liquor pursuant to the offer to purchase from the website is made at our licensed premises attached to Liquor Licence No.51203627.
    • Should you object to any of these Terms and Conditions (including any subsequent amendments), you must immediately discontinue using this website.
  2. TERMS & CONDITIONS OF WINE CLUB MEMBERSHIP
    • I authorise Château Tanunda to debit my credit card with the cost of my wine deliveries each order period
    • I understand that I will receive pre-delivery notification by email of upcoming shipments up to four weeks in advance at which time I can elect to change the content of my delivery
    • I understand that my selection of wines will be used as my preference for future deliveries and that vintages and prices may change and I will be notified in writing
    • The wines I am purchasing are not for re-sale by a licenced person
    • I am 18 years or older
    • To accept delivery there must be a person 18 years or older present to sign
    • Wine Club discounts will not apply in conjunction with other special offers unless specified
    • Benefits can only be claimed on verification of my club membership details
    • I must notify Château Tanunda in writing if I choose to withdraw from the Wine Club after the initial 12-month/two delivery) period
    • By providing your contact details, you acknowledge and agree:
      • to receive emails, SMS’ and phone calls about Chateau Tanunda offers, events and promotions, from us and our agents. You may unsubscribe from these communications at any time by emailing wineclub@chateautanunda.com or using the unsubscribe facility provided in our communications; and
      • to our Privacy Policy (below) including that your personal information will be shared with our agents, so that they may contact you on our behalf, about Chateau Tanunda offers, events and promotions. 
  3. WINE CLUB AND NON-WINE CLUB ORDERS
    • All prices include GST and are quoted in Australian dollars.
    • Please feel free to select any of our wines as part of your order – either one variety or a mixed case.
    • We recommend orders be in multiples of 6 bottles for safest transport. Please feel free to order as many cases as you would like.
    • Château Tanunda currently ships within Australia only.
    • Château Tanunda reserves the right without prejudice to its other rights under these Terms and Conditions or at law to cancel orders or to suspend deliveries until payment is made in full.
    • Château Tanunda reserves the right to alter pricing of a product/products at any time at the sole discretion of the company. In the event that a system error occurs and pricing is displayed incorrectly, Château Tanunda reserve the right to alter pricing and quantity supplied to reflect the correct value.
    • Château Tanunda reserves the right to refuse any order and to withdraw any wines or any range of wines from sale from time to time notwithstanding that such wines may be displayed on Château Tanunda website for purchase.
    • You acknowledge that once an order is made it cannot be cancelled without the written consent of Château Tanunda and on terms whereby you indemnify Château Tanunda for any administration and financial costs incurred by it.
    • LOYALTY WINE CLUB TERMS AND CONDITIONS
      I understand that the Château Tanunda Loyalty Wine Club Membership is dependent upon continual purchase of two (2) wine club dozens annually and automatically debited on my credit card. If no selection has been made I understand I will receive my selected default pack purchase. I understand that the credit card provided will be debited in my selected delivery months when my wine is dispatched.
      Cancellation must be in writing at any time and only after the first 12 months of membership.
      I warrant you that I am of or over 18 years and in the case only where delivery is requested to a person other than the customer, the person named here or to whom delivery is requested is of or over the age of 18 years. Note: For wine to be delivered the signature of a person 18 years or older may be required.
      *Château Tanunda adheres to the Code of Practice of the Australian Direct Marketing Association (ADMA). Château Tanunda will use the information you provide to contact you and fill your orders. By providing your details (including your telephone number) you agree to receive marketing information about products and services from the Château Tanunda Wine Club only until you advise us otherwise by contacting Château Tanunda Wine Club on 08 8563 3888 or in writing to wineclub@chateautanunda.com or to Château Tanunda Wine Club, Château Tanunda, PO Box 316 Tanunda SA 5352. Liquor Licence 51203627.
  4. FREIGHT CHARGES FOR WINE CLUB MEMBERS
    • Delivery is a flat rate of $15 for Mailing List customers,  $10 Australia wide for Wine Club Loyalty Members, except for orders of 18 bottles or more whereby the freight charge is free. Freight is Free for Everest Club Members. Please call us to enquire about costs if your location falls into this category.
    • Château Tanunda reserves the right to charge any freight and handling fee on any special orders. Château Tanunda reserves the right to change freight charges.
  5. FREIGHT CHARGES FOR NON-WINE CLUB MEMBERS
    • Château Tanunda has a simple national flat-pricing for almost 90% of households in Australia.
    • Australia Wide: $15 per order
    • The Delivery becomes freight free for orders of 18 bottles or more.
    • Freight will be calculated at the time of invoicing.
    • Château Tanunda reserves the right to charge any freight and handling fee on any special orders. Chateau Tanunda reserves the right to change freight charges.
  6. DELIVERY
    • Please allow 7-10 working days for your wine to be received after receiving confirmation of your order.
    • If you have not received your wines in this timeframe, please contact us and we will trace your delivery.
    • You are responsible for providing full and accurate delivery address, contact numbers and instructions. Re-delivery because of any failing in these aspects will be to your account.
    • To ensure correct delivery – please be aware that if you are not available to receive delivery:
      • Australia Post will leave a card informing you of wines available for collection at your post office if there is no-one home to take delivery. Australia Post will not leave the wines unattended as they follow responsible conduct law.
    • Delivery times made known to you are estimates only and Château Tanunda is not liable for any late or non-delivery.
    • Without limiting the operation of any other Terms and Conditions herein, you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancel an order.
    • Without limiting the operation of any other Terms and Conditions herein, Château Tanunda will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.
    • Château Tanunda is not liable for any loss, damage or delay occasioned to you or any other person claiming through you arising from late or non-delivery of the wine ordered.

  7. RETURNS POLICY
    • Should you receive a case of wine that appears to have been damaged in transit we will provide you a replacement, or an alternative product of equal value of your choice, or a full refund. Should you receive a product that is different to what you ordered then we will provide you a replacement (if product is available), or an alternative product of equal value of your choice, or a full refund. If you are dissatisfied with the product you received you can return them for a full refund (provided that at least 9 bottles from the case are returned to us in good condition), under the following circumstances:
      • The un-opened wine bottles are returned within 7 days of opening any of the wine cases, and upon internal testing of the product by Chateau Tanunda it is deemed faulty or defective.
      • We will refund your money when we receive the goods and we are satisfied that they are in original condition.
      • You will need to supply the following information, most of which will be on your Invoice upon returning the product:
        • Your Name and Contact Details
        • The Invoice Number & Invoice Date
        • Description of Product to be Returned
        • The Reason for Return
    • All returns are to be delivered to: Chateau Tanunda (AFBG Pty Limited), PO Box 316, Tanunda, SA, 5352
    • For enquiries contact us via info@chateautanunda.com or (08) 8563 3888. We will bear the reasonable cost of returning goods that are defective, do not meet the product description or were sent in error. All other returns are at your expense.
    • Damaged in transit
      • In the event that you receive a product that appears to have been Damaged in Transit you should:
        • Refuse to accept delivery of the product.
        • Direct the Courier to Return Goods to Sender.

      • If you have already accepted delivery, and then notice that the product appears to have been damaged during transit you should notify us immediately, so we can process the return as “Damaged in Transit”.
  8. PRIVACY POLICY

    Château Tanunda Privacy Policy

    Australian Food & Beverage Group Proprietary Limited (Château Tanunda) believes the responsible collection and use of personal information is fundamental to developing a business based on enduring relationships with its customers, suppliers, owners and staff. “Personal information” is defined as information or an opinion through which an individual’s identity is apparent or can be reasonably ascertained.

    Château Tanunda is bound by the National Privacy Principles in the Privacy Amendment (Private Sector) Act 2000. Château Tanunda is committed to respecting the individual’s right to privacy and has developed honest, transparent protocols to ensure personal information is handled appropriately.

    COLLECTING YOUR PERSONAL INFORMATION

    • Information is only collected if it is required for one or more of Château Tanunda functions.
    • It is collected by fair and lawful means and not in an intrusive way.
    • Château Tanunda prefers to collect information directly from the individual.
    • Château Tanunda will take reasonable steps to inform the individual that the collection has occurred, why the collection occurred and how the information may be accessed.
    • By joining our mailing list (CHATEAU TANUNDA mailing list) you are giving your consent to be contacted by us for an indefinite period. You may of course opt out from our wine club at any time by simply calling or emailing us.
    • Terms of joining our Mailing Club List:
    • By providing your contact details, you acknowledge and agree:
      to receive emails, SMS’ and phone calls about Chateau Tanunda’s offers, events and promotions, from us and our agents. You may unsubscribe from these communications at any time by emailing us at wineclub@chateautanunda.com or using the unsubscribe facility provided in our communications; and to our Privacy Policy including that your personal information will be shared with our agents, so that they may contact you on our behalf, about Chateau Tanunda offers, events and promotions. 

    USE AND DISCLOSURE

    PERSONAL INFORMATION IS NEVER SOLD TO OTHER PARTIES.

    SPECIFIC NEEDS

    To meet the individual’s specific needs Château Tanunda may disclose the personal information to the organisations which:-

    • provide/manage/administer a service or product such as the share registry, printers and mail out house
    • are involved in the payments system including financial institutions, credit card providers and payment organisations
    • are involved in the maintaining, reviewing and developing Château Tanunda’s business systems including testing or upgrading our computer systems
    • provide legal or accounting advice
    • require or are authorised by law to access the information.

    MARKETING Château Tanunda WINES

    • Over the years Château Tanunda has collected information for the development of direct mailing lists to let consumers know about the availability of Château Tanunda for sale. This may be done after an initial contact and we assume we have the individual’s consent to use service providers to assist us with this unless Château Tanunda is told otherwise.
    • Wine offers are made direct to owners through the use of the shareholder list.
    • From December 2001 onwards each direct marketing communication will prominently display a notice whereby the recipient can elect to opt out of receiving any further direct marketing communications.

    EMAIL MANAGEMENT

    • Website visitors email addresses are only recorded if the user chooses to leave a message.
    • An email address will only be used for the purpose for which it was provided.
    • Individuals who have chosen to join an email list may opt out simply by advising Château Tanunda that the address is to be removed from the mailing list.

    WEBSITE

    Château Tanunda does not collect any personal information about an individual when the website is visited unless the user chooses to provide such information. The information received depends upon what the user does when visiting the site.

    Site Visit Data – the following is recorded and collected for statistical purposes:-

    • The server address of the visitor
    • The name of the top-level domain from which the internet was accessed
    • The date and time of the visit to the website
    • The pages accessed and documents downloaded

    The recording of such information enables us to identify the areas of the site that are most popular and to tailor the site accordingly.

    Links – the website contains links to other sites. Château Tanunda is not responsible for the content and privacy practices of other web sites.

    KEEPING PERSONAL INFORMATION ACCURATE AND UP-TO-DATE

    Château Tanunda will take all reasonable steps to make sure personal information we collect, use or disclose is accurate, complete and up-to-date.

    If an individual believes the personal information is not accurate, complete or up-to-date please contact the Company.

    DATA SECURITY

    Château Tanunda protects against misuse; loss; unauthorised access, modification or disclosure of personal information by:

    • Requiring all employees to observe confidentiality protocols
    • Controlling access to the premises and paper based systems
    • Adopting measures to secure the computer network used for storing, processing and transmitting personal information
    • Protecting communications via data transmission from interception eg email and unauthorised access to the computer network.

    Personal information is retained only for as long as necessary to fulfil the purposes for which information was collected or as required by law. Once used for the intended purpose paper documents containing personal information are shredded.

    OPENNESS

    The Château Tanunda Privacy Policy is available from the company’s website or on request from the Company.

    ACCESS AND CORRECTION

    • An individual may gain access to personal information provided the request for access is not frivolous, vexatious, unlawful, or prejudicial to negotiations between Château Tanunda & the individual.
    • Château Tanunda endeavours to provide access within 10 business days of the written request. Château Tanunda will verify the identity of the individual seeking access prior to the information being provided. If it is a complex issue Château Tanunda will advise the individual accordingly but will use all reasonable endeavours to provide access within 20 business days of the written request.
    • If access is denied then written reasons will be provided as to why access was denied.

    IDENTIFIERS

    In certain circumstances we are required to collect government identity numbers eg tax file numbers. Château Tanunda does not use these numbers to identify individuals for its own purposes.

    ANONYMITY

    Château Tanunda does not require individuals to provide personal information unless the information is required to do business.

    SENSITIVE INFORMATION

    Château Tanunda does not collect “sensitive information” about an individual. Sensitive information means information or an opinion about an individual’s:

    • Racial or ethnic origin; or
    • Political opinions; or
    • Membership of a political association; or
    • Religious beliefs or affiliations; or
    • Philosophical beliefs; or
    • Membership of a professional or trade association; or
    • Membership of a trade union; or
    • Sexual preferences or practices; or
    • Criminal record
    • Health status
